A BILL to amend article one, chapter twenty-five of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
twelve, relating to requiring division of corrections to
compile and maintain a database of violent offenders; and
creating the violent offender registry act.
Be it enacted by the Legislature of West Virginia:
That article one, chapter twenty-five of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
twelve, to read as follows:
ARTICLE 1. ORGANIZATION AND INSTITUTIONS.
§25-1-12. The violent offenders registry act.
Effective the first day of July, two thousand one, the
division of corrections shall create and maintain a database and
internet site with the names, photographs and criminal records of
all violent offenders. The database shall be made available to
the general public.
For the purposes of this section, which shall be known as
the "Violent Offenders Registry Act," a violent offender is a
person who has been convicted of an offense involving force
against the person or the threat of violence, or whose criminal
acts result in the injury or death of any person.
NOTE: This bill creates the "Violent Offenders Registry Act"
which requires the Division of Corrections to compile and
maintain a database of violent offenders and to make this
information available to the general public.
